Myanmar Trademark Law 2019: A Practical Overview

Myanmar Trademark Law 2019 provides the framework for the country’s modern trademark registration system. For international IP firms and corporate brand teams, a useful starting point is to connect the legal framework with the documents and instructions needed for each application.

The registration framework

The law was enacted on 30 January 2019. It came into force on 1 April 2023, and the formal acceptance of trademark registration applications commenced on 26 April 2023. These dates describe different stages of the system’s introduction.

Marks and refusal grounds

Distinctiveness matters. Section 13 addresses absolute grounds for refusal, including lack of distinctive character. Section 14 addresses relative grounds, including conflicts with earlier marks. The proposed goods and services must therefore be considered alongside the sign itself.

Publication and opposition

Applications that reach publication can be opposed. Section 26 provides a 60-day opposition period from publication. A published application is not the same as a granted registration.

Registration and renewal

The law provides a registration term of ten years from the filing date and renewal for further ten-year terms. Keeping ownership and registration details organised supports later renewal and recordal work.

Preparing instructions in practice

Before starting a matter, confirm the legal applicant, the exact version of the mark and the goods and services to be covered. Where several related companies use a brand, resolve the intended ownership before the application draft is prepared.

Send any priority information with the first instructions. A complete initial file allows the local team to identify missing documents and discuss the proposed filing approach before submission.

Search and application preparation

A search report is one input to the filing decision. Its coverage and limitations should be read together with the assessment. Our Trademark Search service explains the records available for our present searches, while the Filing Guide sets out the information we request.
